Eligibility Criteria for the O-1A Visa

Applicants must demonstrate sustained national or international acclaim and meet at least three of the following criteria, or provide evidence of a one-time major achievement (e.g., Nobel Prize, Pulitzer Prize, or Olympic medal):

  • Receipt of nationally or internationally recognized awards or prizes for excellence in their field.
  • Membership in associations requiring outstanding achievement, as judged by recognized experts.
  • Published material about the applicant’s work in professional or major trade publications or media.
  • Original contributions of major significance to their field, evidenced by patents, citations, or other documentation.
  • Authorship of scholarly articles in professional journals or other major media.
  • Evidence of a high salary or remuneration compared to peers in the field.
  • Judging the work of others in the same or allied field, such as serving on expert panels or juries.
  • Employment in a critical or essential capacity for distinguished organizations or establishments.
  • Coming to the U.S. to work temporarily in their field of extraordinary ability, supported by a U.S. employer, agent, or sponsor.

Family Members

Spouses and unmarried children (under 21) of O-1A Visa holders can accompany them on an O-3 Visa, valid for the same duration as the applicant’s visa and subject to the same limitations.

Is there a cap on the number of O-1A Visas issued annually?
No, there is no annual cap on O-1A Visas.
The initial stay for an O-1A Visa can be up to three years.
Yes, extensions are possible. USCIS evaluates extensions on a case-by-case basis, granting up to one year per increment with a new Form I-129, Petition for a Nonimmigrant Worker.
No, O-3 Visa holders cannot work in the U.S. However, they can study full-time or part-time.
